GMAC Broke Into My Client’s Home

by Joshua Jarvis on April 30, 2009

It happening, really.

You move out and put your home on the market. You drive by one day, or maybe the Realtor calls and says, “my key is not working anymore…”

It’s happened. That’s right the bank has broken into your home, winterized it and “secured it.” If you are lucky, maybe they’ll mail you the key.

It’s not enough that the bank decided to do this to your home, heck, in some cases, it might be a favor. Afterall, it saves you money on the winterizing part of home. If you are trying to short sale, you might be short on cash, so it’s a favor.

What really bothers me is that they are sending out complete strangers to BREAK INTO YOUR HOME because it APPEARS vacant. Hope you don’t decide to get your home painted or floors refinished. Don’t get new furniture and go on vacation.

Investors, hope you can find tenants quickly!

So what can you do about it? Nothing really. The bank has a security deed on your property, so technically they are part owners. In addition, they have a duty to maintain the property.

GMAC is the first bank to do this to one of my clients, as in GENERAL MOTORS. Locally, the realtors that work at Metrobrokers are affiliated with this brand.

To be fair, I imagine that there are other banks that are as retarded as this.
